Terms of Service
By installing or using PixMatch (“the App”) on a Shopify store, you agree to these Terms. If you do not agree, uninstall the App.
1. The service
PixMatch helps merchants match bulk product photographs to Shopify product variants and publish them after an explicit review step. The App is provided as software-as-a-service integrated with Shopify Admin.
2. Eligibility
You must be authorized to install apps on the Shopify store and to grant the requested Admin API scopes (read_products, write_products).
3. Your responsibilities
- Provide accurate product identifiers (SKU / barcode / handle)
- Review matches before confirming publish
- Ensure you have rights to upload images and to connect third-party sources (e.g. Dropbox)
- Keep Shopify and connected accounts secure
4. Acceptable use
You may not misuse the App to infringe IP, abuse rate limits, reverse-engineer beyond applicable law, or process unlawful content. We may suspend access for abuse.
5. Third-party services
Shopify, Dropbox (optional), and hosting providers operate under their own terms. PixMatch is not responsible for outages or policy changes of those platforms.
6. Intellectual property
You retain rights to your catalog and images. We retain rights to the App software, branding, and documentation. Feedback you submit may be used to improve the product without obligation.
7. Disclaimer
The App is provided “as is”. Matching depends on your filenames / CSV data and catalog quality. We do not warrant uninterrupted availability or error-free matching. Always review before publish.
8. Limitation of liability
To the maximum extent permitted by law, XBRAIN srl is not liable for indirect, incidental, or consequential damages, lost profits, or data loss arising from use of the App. Aggregate liability is limited to fees paid for the App in the three months preceding the claim (or zero if the App is free).
9. Billing
Pricing may change as plans are introduced. Charges, if any, are processed through Shopify Billing. Uninstalling stops future charges according to Shopify’s billing rules.
10. Termination
You may uninstall at any time. We may terminate access for breach or to retire the service with reasonable notice when practicable. Data handling after uninstall is described in the Privacy Policy.
11. Governing law
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules, except where mandatory consumer protections apply.
